Why UAE and GCC Nationals Are Establishing Malta Residency

The Gulf region’s geopolitical environment has shifted materially in recent years. For UAE residents, GCC nationals, and internationally mobile families based in the region, the question of a credible Plan B, a stable European base with legal residency rights, has moved from an abstract consideration to an active priority.

Malta offers a direct answer. As the only English-speaking EU member state, Malta provides permanent residency rights, visa-free Schengen travel across 26 European countries, and access to a stable, rule-of-law jurisdiction with a familiar common-law legal system. The Malta Permanent Residence Programme is open to all non-EU, non-EEA, and non-Swiss nationals. Including UAE and GCC nationals and grants indefinite residence rights from the point of approval.

For UAE-based families with assets, business interests, or dependents requiring long-term security, Malta residency provides a legally robust alternative base within the European Union that does not require relocating immediately or abandoning existing commitments in the Gulf.

Malta’s Tax Framework for Non-Domiciled Residents

Malta taxes non-domiciled residents on a remittance basis. Foreign income and gains are not subject to Maltese tax unless brought into Malta. Capital gains on assets situated outside Malta are fully exempt, even if remitted. There is no inheritance tax, no wealth tax, and no capital gains tax on assets held outside Malta.

For UAE and GCC nationals who are accustomed to a zero-income-tax environment, Malta’s remittance basis provides a familiar and highly competitive structure within the European Union. Individuals holding residence under the Global Residence Programme pay a flat rate of 15% on foreign income remitted to Malta, subject to a minimum annual tax of €15,000. Income and assets remaining outside Malta are not subject to Maltese tax.

Malta has concluded over 70 double taxation agreements, providing treaty protection across the key jurisdictions where UAE-based HNWIs typically hold assets and business interests.

The Malta Permanent Residence Programme — MPRP

The MPRP is Malta’s primary residency-by-investment programme, open to non-EU nationals and their qualifying dependants. It grants permanent residency rights in Malta — the right to reside indefinitely — alongside Schengen Area mobility.

A temporary residence permit is issued at the application stage, meaning applicants can legally relocate to Malta while the full application is processed over the following six to eight months.

Citizenship by Merit — Malta’s Naturalisation Pathway

Malta’s Citizenship by Merit programme, introduced under Legal Notice LN159/2025, provides a selective naturalisation pathway for individuals whose exceptional achievements or contributions are of significant value to Malta. Unlike previous investment-based citizenship routes, Citizenship by Merit is assessed on the basis of measurable impact and national relevance rather than a fixed financial contribution.

Eligible fields include scientific research and innovation, entrepreneurship and economic development, technology and digital advancement, arts, culture and sport, philanthropy, and public health. Applications are evaluated by an Independent Evaluation Board appointed by the Minister, with a focus on how the applicant’s contribution benefits Malta’s economy, global positioning, or societal development in alignment with Malta Vision 2050.

Additional requirements include evidence of at least eight months of residence in Malta, access to adequate residential housing, and demonstrated genuine links to Malta consistent with the proposal. FAQ's - Malta for US Nationals

Can US citizens apply for Malta residency?

Yes. US citizens qualify for both the MPRP and GRP as third-country nationals. The MPRP grants indefinite residence. The GRP combines residence with a 15% flat tax on foreign income remitted to Malta. ARQ manages applications for both and confirms eligibility at the initial consultation.

Does Malta residency change my US tax obligations?

No. The US taxes citizens on worldwide income regardless of residency. Malta residency does not reduce your US tax liability while you retain citizenship. The US-Malta DTA provides foreign tax credit mechanisms to prevent double taxation, but the savings clause preserves US taxing rights. Malta’s estate and tax advantages become fully applicable after formal expatriation.

What is the US exit tax, and how does Malta residency help with planning?

The US exit tax (IRC 877A) applies a mark-to-market deemed sale on covered expatriates (net worth above $2M, average annual tax above $206k, or incomplete compliance). Unrealised gains above $910,000 (2026 exclusion) are taxed. Establishing Malta residency before expatriation creates a settled base for a compliant departure. 

Is there a social security agreement between the US and Malta?

No. The US and Malta do not have a Totalization Agreement. Self-employed US citizens or those working for US employers may face social security contributions in both jurisdictions. ARQ advises clients to consult a US-licensed tax adviser on this.

Does Malta’s zero inheritance tax apply to US citizens?

While you retain US citizenship, the US estate tax applies to worldwide assets. Malta’s zero IHT becomes fully applicable after formal expatriation. Establishing Malta residency and estate structuring before departure is the approach ARQ advises.

How long does an MPRP application take?

The MPRP typically takes six to eight months from application to approval. A temporary residence permit is issued at the application stage under the July 2025 programme update, allowing applicants to relocate to Malta and begin establishing residence during this period.
